About these terms

These terms govern your use of the swiftfleet website. By browsing the site or submitting a consultation request you accept them. If you do not accept them, please do not use the site. Separate written terms apply to any consulting engagement and, where they conflict with these terms, the engagement terms take precedence for that work.

Using this website

You may view, download and print pages of this site for your own use or for the internal purposes of your organisation. You agree not to misuse the site, which includes attempting to gain unauthorised access to it, interfering with its normal operation, scraping it at a scale that affects its availability, or using the consultation form to send unsolicited advertising or unlawful content.

The information on this site is general

The content on this website describes the kind of work swiftfleet does. It is general information, not property, financial, legal, tax or construction advice, and it does not take account of your circumstances. No adviser and client relationship is created by reading this site or by submitting the form. Advice you can rely on is given only under a signed engagement that sets out its scope, its assumptions and its limits.

Enquiries, proposals and engagements

Submitting a consultation request places no obligation on either side. We will normally reply within one business day to arrange an introductory conversation. If we go further, you will receive a written proposal setting out scope, deliverables, timing and fees, and work begins only once you accept it in writing. We may decline an enquiry, including where we identify a conflict of interest or where the work falls outside what we do.

Fees and payment

Fees are set out in the proposal for each engagement, on a fixed, capped or time basis as stated there. Nothing on this website is a quotation or an offer capable of acceptance. Where expenses such as travel or third-party reports are expected, they are identified in the proposal before they are incurred. Payment terms, including invoicing intervals, are set out in the engagement terms.

Confidentiality

Information you send us through this site or by email in connection with a possible engagement is treated as confidential and is used only to assess and respond to your enquiry. We will sign a non-disclosure agreement on request. Please note that email is not a secure medium, so avoid sending highly sensitive material until we have agreed how to exchange it.

Intellectual property

The text, layout, graphics and other material on this site belong to swiftfleet or are used with permission, and are protected by intellectual property law. You may not copy, republish or adapt them for commercial purposes without our written consent. Ownership of material we produce during an engagement is dealt with in the engagement terms; in general you receive the right to use the deliverables for the purposes they were prepared for.

Availability of the site

We aim to keep the site available and its content current, but we do not guarantee uninterrupted access. The site may be unavailable during maintenance or for reasons outside our control, and we may change, suspend or withdraw any part of it without notice.

Limitation of liability

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud. Subject to that, we are not liable for any loss arising from reliance on the general information published on this site, or for indirect or consequential loss, loss of profit, loss of contracts or loss of data arising from your use of it. Liability in respect of a consulting engagement is governed by that engagement, which states the applicable cap.

Governing law

These terms and any dispute arising from them are governed by the laws of the jurisdiction in which swiftfleet is established, and the courts of that jurisdiction have exclusive jurisdiction. The governing law and forum for a specific engagement are stated in the engagement terms for that work.

Changes to these terms

We may revise these terms from time to time. The version published on this page at the moment you use the site is the version that applies, and the date at the top shows when it was last revised. Continued use of the site after a change indicates acceptance of the revised terms.
